Astute Graphics has partnered with Paddle.Com Market Limited ("Paddle") to streamline its order fulfilment process to ensure an effective and efficient customer experience so that Astute Graphics can concentrate on delivering a great product.
So that Paddle is able to take all responsibility and liability for international and local payment methods, global sales tax liability and full service billing support on behalf of Astute Graphics, Astute Graphics has appointed Paddle as its Merchant of Record and authorised reseller of the Product which means that whilst you acquire the Product from Paddle, it is licenced by Astute Graphics who remain responsible for all matters relating to supply or quality of service and/or performance of the Product.
[Paddle does not make, and has not made, any representation or warranty that the Products provided under this agreement are accurate, complete, reliable, current, error-free, or virus-free and Paddle shall accordingly have no liability arising in connection with any claims arising from such matters.]
You acknowledge and agree that in its capacity as Astute Graphics‘s Merchant of Record, all charges under this agreement are to be paid to Paddle.
Paddle will invoice you in accordance with Astute Graphics‘s instructions and you shall pay such invoices to Paddle by electronic transfer to the bank account details included in the invoice or other payment method indicated in the invoice (such as credit or debit card, PayPal or local payment methods).
Astute Graphics acknowledges and agrees that payment to Paddle will be deemed to be payment of the relevant amount due from you pursuant to these terms and receipt of the relevant payment by Paddle will be a discharge of your obligation to pay the same.
Where any credit or refund is to be given to you pursuant to these terms, Paddle will make such credit or refund on receipt of funds from Astute Graphics to do so. You acknowledge that Paddle shall have no liability to effect such credit or refund unless and until it is funded by or on behalf of Astute Graphics to do so.
Paddle is responsible for providing first tier after sales support to you, this includes billing queries and initial order-related support. Astute Graphics remains responsible for providing all other on-going maintenance and support for the Product.
Paddle will maintain appropriate administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of your data in compliance with all relevant legislation (including but not limited to The General Data Protection Regulation (EU) 2016/679 (GDPR)), as described in Paddle's Buyer Privacy Policy which can be found at https://paddle.com/privacy-buyers/ (or such other URL that Paddle may provide from time to time).
